Return/Refund Policy:
All product sales/Leases are final and cannot be returned or exchanged.

PRODUCT PERFORMANCE GUARENTEE .

 

If your product comes with a performance guarantee; Computer Day Trader Inc. will refund your lease payment under the following conditions:

1. You must make every trade which the product makes during the one year trading period.

2. You must present your brokerage trading statements for the trading period.

3. There are no exceptions to the requirement to make the trades due to electronic, computer, data feed or other errors/failures or any other cause.

4. You must keep your account fully funded during the one year trading period.

5. You must begin trading within three days of receiving the software.

Before deciding to undertake such transactions a user should carefully evaluate whether his/her financial situation is appropriate for such transactions. Trading foreign exchange may result in a substantial or complete loss of funds and therefore should only be undertaken with risk capital. The definition of risk capital is funds that are not necessary to the survival or well being of the user. Trading online, no matter how convenient or efficient it may be, does not necessarily reduce the risks associated with foreign exchange trading.

Please, read this carefully. This is a legal agreement between you and the Company "Computer Day Trader Inc.". By installing and/or using the Software on a computer, you are agreeing to be legally bound by the conditions of this agreement. You understand and agree that this agreement has the same binding legal force and effect as it would if you and Developer signed this document in ink and delivered it to one another in person. There is no refund or exchange for the product. Unless you agree to all conditions of this agreement, including all limitations on the liability of the Company and Authors, and assumptions of risk described below you may not use the product.

1. GRANT OF LICENCE.

(a) The Company and Developer grants to you a nonexclusive license to use one copy of the Software. Your right to use the program terminates and may be terminated by The Company and Developer immediately if you violate any of agreements set forth in this agreement. This Agreement and the license granted may not be transferred, assigned, leased, rented, sublicensed or otherwise transferred by you. In no event shall the program be used by you for, or in connection with, any unlawful purpose.

2. OWNERSHIP AND COPYRIGHT.

The Software has been developed by "The Company and Developer " . The Software was developed, compiled and tested through the expenditure of substantial time, effort and money. Methods and standards of judgment used in development of Software and constitute confidential and valuable property and are protected by international treaty provisions as well as other intellectual property laws and treaties. All ownership and copyrights in and to the Software and any accompanying printed materials are owned by company "Computer Day Trader Inc. and Developer". You acquire only a nonexclusive license to use the Software subject to this Agreement. You agree not to duplicate, reproduce and publish the Software.

You may not directly or indirectly offer or transmit all or any portion of the Software or its trades to the third parties whether by way of license, rent, sale or otherwise. You may not modify, de-compile, disassemble, and also make any operation that break or change its algorithm.

3. USING THE SOFTWARE TO MAKE INVESTMENT AND TRADING DECISIONS OR TO INITIATE TRADES.

All software, including the Software, contains errors. You are strongly advised to verify information prior to making any trade or investment.

AS BETWEEN AUTHORS AND YOU, SOLELY YOU FULLY ASSUME THE RISK THAT ERRORS OR INACCURACIES IN THE SOFTWARE MAY RESULT IN YOUR REACHING CONCLUSIONS THAT YOU MIGHT NOT OR WOULD NOT HAVE REACHED HAD SUCH ERRORS AND/OR INACCURACIES NOT BEEN PRESENT. FURTHER, AS BETWEEN AUTHORS AND YOU, SOLELY YOU FULLY ASSUME THE RISK THAT SOFTWARE ERRORS MAY CAUSE FAILURES IN THE TRANSMISSION OF INFORMATION THROUGH THE INTERNET OR OTHER CHANNELS, AND ALSO AS A RESULT OF ERRORS AND FAILURES BECAUSE OF THE SOFTWARE TECHNICALLY UNCOMPATIBLE.

4. PRODUCT SUPPORT AND UPGRADES.

The price paid to lease the Software relates only to it and to no other products or services, including upgrades or technical support, that The Company and Developer may offer from time to time.

5. Confidentiality

You acknowledge that the Software contains proprietary trade secrets of Computer Day Trader Inc. and you hereby agree to maintain the confidentiality of the Software using at least as great a degree of care as you use to maintain the confidentiality of your own most confidential information. You agree to reasonably communicate the terms and conditions of this Agreement to those persons employed by you who come into contact with the Software, and to use best efforts to ensure their compliance with such terms and conditions.
